1.- The hirer and any aditional drivers must be over 25 years of age and be in possesion of a driving licence that had been held for more than a year. Both the hirer and aditional drivers duly undertake not to permit any other persons nto authorised by Haro Rent a Car S.L. to drive the vehicle.
2.- The hirer undertakes to keep the vehicle locked when it is not in use.
3.- The hirer cannot sell or transfer the vehicle, or its kit of tools. Failure to comply with this shall result in the immediate repossession of the vehicle by Haro Rent a Car S.L.
4.- The Hirer acknowledges that he or she has received the vehicle in perfect condition, with its five tyres and wheels in good order. In the event of loss or deterioration of any of these, the hirer undertakes to immediately replace same, always with tyres or wheels of identical characteristics and state of use.
5.- Neither the milometer of the vehicle hired, or its connections, can be manipulated. In the event of any manipulation, the hirer must pay for the hire on the basis of 300 kms. per day, irrespective of the indemnification that may correspond for fraudulent usage.
6.- The hirer shall be responsible for the expenses of the tow away truck and for the days of non availability of the vehicle as a result of accident, breakdown or rentention, in the event of these being the result of negligence on the part of the driver, likewise, breakdowns outside the area of coverage. All this shall be invoiced at the current tariff.
7.- The hirer shall be responsible for traffic fines, likewise any expenses corresponding to infractions of the current legislation in respect of the Road Traffic Act.
8.- The vehicle can only be driven within the region of Andalucia.
INSURANCE
Haro Rent a Car S.L. includes, at no extra cost, in the vehicle rental price, the obligatory motor insurance, the cover in respect of civil liability for damage to third parties as a result of use and circulation of the vehicle and a surety with unlimited guarantees. For this, the hirer and any driver authorised by Haro Rent a Car S.L. shall participate as the insured party in the benefits of a Motor Insurance Policy, accepting the terms and the conditions thereof.
Haro Rent a Car S.L. offers all its clients the possibility of protection of its users from the total or partial liability of the vehicle in the event of collision, theft or acts of vandalism.
The client can contract in advance at an additional cost, according to group or model, one of the following types of cover: CDW ( Collision Damage Waiver ) or Super CDW. These options are not an insurance policy, but represent cover offered by Haro Rent a Car S.L. They are not applicable to persons under 29 years of age or persons over 70 years of age.
Option 1.- CDW: This partially exempts the driver from financial liability in the event of collision, theft ( not of personal items left in the vehicle by the hirer) or acts of vandalism. The user shall only be partially responsible for payment of a sum ( excess).
Option 2.- Super CDW: This totally exempts the driver from financial liability in the event of damage to the vehicle through collision, theft or acts of vandalism.
The CDW and Super CDW cover shall be annulled under the following circunstances:
1.- All accidents due to negligence on the part of the driver. As a result of dangerous driving, being under the influence of alcohol or drugs, speeding.
2.- Failing to respect traffic signs ( traffic lights, stop and give way signs, roundabouts, continuous lines, etc....).
3.- The vehicle being driven by a person other than those shown in the rental contract.
4.- Failure of clutch through misuse thereof.
5.- Loss of keys.
6.- Damage to the vehicle interior such as burns or breakage of the seats, or any other damage caused by the user.
The hirer undertakes to pay the renting company for all damage occasioned by collision or turning over of the vehicle owing to negligence on the part of the driver. The driver shall meet the total cost of the damage and stoppage occasionad to the Haro Rent a Car S.L. vehicle. The cost shall be charged to the credit car left as deposit.
EXCLUSIONS FROM THE INSURANCE:
The hirer shall assume full liability in the event of not having contracted any of the cover offered by Haro Rent a Car S.L., in the following circunstances:
1.- All the circunstances mentioned above, which annul the CDW and Super CDW.
2.- Breakage of the vehicle´s windscreen and windows ocurring either fortuitously or the result of theft from the interior of the vehicle of items that the hirer had left there.
3.- Damage suffered by the vehicle when same be the result of collision or impact against trees, tunnels, bridges, garages, guadrails, unevenness or poor condition of the road surface or street or , in general, against any other object, as a consequence of a driving error on the part of the driver.
4.- Damaged occasioned to the underneath of the vehicle.
The hirer is obliged to protect the interests of the rental company and of the insurance company in the event of an accident during the period of validity of this contract, in the following manner:

Immediately informing the Police and offices of Haro Rent a Car S.L.

Obtaining, the sames and addresses of the persons involved in the accident, likewise of possible witnesses.

Never admiting either responsibility or guilt.

Not abandoning the vehicle without taking adequate steps to protect same.

Visiting the Haro Rent a Car S.L. offices within the following 24 hours to hand over the duly completed accident report and to inform of same.
In the event of the hirer failing to comply with any of the requirements indicated above, should they be applicable, Haro Rent a Car S.L. could claim from said hirer for damage occasioned by the negligence of the latter, even though he or she had accepted the purchase of the CDW or Super CDW, which, in such case, would be rendered invalid.
Haro Rent a Car S.L. undertakes no liability for items transported in the vehicle.
The contract shall terminate on the date established by the client. If an extension is required, this must be agreed beforehand and paid for in advance. Failure to comply with this requirement shall constitute improper use of the vehicle and suspension of the insurance.
Haro Rent a Car S.L. declines all liability for damage to property owing to an accident involving the rented vehicle, likewise declining all liability fi the hirer has deliberately supplied Haro Rent a Car S.L. with incorrect information as to his or her identity, address, or validity of driving licence.
PETROL:
Petrol is at the hirer´s expense. Vehicles must be returned with the petrol tank at the same level as when it was handed over. Should this not be the case, Haro Rent a Car S.L. will charge the hirer for the missing petrol at the prevailing price, plus 20 euros for the service.
The hirer must also monitor the levels of oil and water.
MAINTENANCE AND REPAIRS:
The normal mechanical wear and tear on the vehicle is assumed by Haro Rent a Car S.L.
LEGISLATION AND JURISDICTION:
The present contract refers to and shall be interpreted in accordance with current Spanish Law. For any dispute derived from the interpretation or compliance with the stipulations of same both parties subject themselves to the Courts of Estepona or Malaga.
